Suing OBGYN for withholding records until we pay?

You can't sue for emotional distress OR punitive damages. Those can only be ADDED to a suit for other monetary damages. Which you don't have. Besides, why are YOU going to sue when YOU are responsible. You aren't paying your bills, so you are instigating the action. If you try to take him to court, the response is going to be "if they paid their bills, there wouldn't be a problem!" And, who do you think the judge is going to side with? The doctor that isn't being paid for services, or the deadbeat client that isn't paying?
